[Breaking News] Nichia Enforces Newly-Granted YAG Patent Against Everlight in Germany

A new white LED patent which covers, among others, YAG phosphors has been granted by the European Patent Office in favor of Nichia Corporation ("Nichia"), namely EP 2 197 053.

With the grant of this new patent, Nichia has immediately started to enforce the patent against Everlight. On June 26, Nichia broadened on the basis of EP 2 197 053 the German patent infringement complaint against Taiwanese Everlight Electronics Co., Ltd. and its German subsidiary Everlight Electronics Europe GmbH (both "Everlight") relating to EP 936 682 (DE 697 02 929 – the "YAG Patent"), which is currently pending with the Düsseldorf Higher Regional Court. With the broadening of the complaint, Nichia is seeking in particular permanent injunction, rendering of accounts and damages concerning Everlight's white LED product 67-21S/KK2C-H5050M41N42936Z6/2T. Nichia believes that this white LED product of Everlight infringes EP 2 197 053.

With the newly-granted patent Nichia underlines its innovativeness in white light LED technology.

Nichia seeks to protect its patents and other intellectual property rights and takes actions against alleged infringers in any country where appropriate and necessary.
