Tokyo District Court Dismisses Everlight’s Patent Claims against Nichia

Nichia reported a new update of its patent lawsuit with Everlight, the Taiwanese package company.

On October 5th, 2018, the Tokyo District Court in Japan dismissed Everlight’s claims in a patent infringement lawsuit for injunctions against Nichia, Citizen Electronics and Daiko Electric.

In the Lawsuit, Everlight claimed that the COB product manufactured by Nichia, Citizen and Daiko and the lighting fixture with COB product mounted thereon infringe Japanese Patent No. 3989794, but the court rejected Everlight’s claims thoroughly.

Everlight announced that the Supreme Court of the United State has confirmed the invalidity of Nichia’s assertions about its YAG patent on October 1st, 2018. Earlier in July, Nichia also announced its YAG patent was confirmed by the German Federal Patent Court while the nullity action of Everlight was rejected.
